Kullanım Koşulları

Steed Studio uygulama ve oyunlarını kullanırken geçerli olan kurallar.

Bu Kullanım Koşulları ("Koşullar"), Halit Gümüş tarafından "Steed Studio" adıyla yayınlanan tüm mobil uygulamaların, oyunların ve ilgili hizmetlerin ("Uygulamalar") kullanımını düzenler. Bir Uygulamayı indirerek veya kullanarak bu Koşulları kabul etmiş olursunuz. Kabul etmiyorsanız lütfen Uygulamaları kullanmayın.

Uygulamaları kişisel kullanımın için kullanabilirsin. Hile yapma, uygulamayı kopyalama veya kötüye kullanma. Coin ve elmas gibi sanal öğelerin gerçek para değeri yoktur. Ödemeler ve iadeler Apple üzerinden yapılır. Gizlilikle ilgili konular Gizlilik Politikası'nda anlatılır.

01Apple lisans sözleşmesi

App Store'dan indirilen Uygulamalar, Apple'ın Standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi ("Apple EULA") kapsamında lisanslanır. Bu Koşullar Apple EULA'yı tamamlar. İkisi arasında çelişki olursa, App Store'dan indirilen Uygulamalar için Apple EULA geçerli olur.

Bu Koşullar sizinle Halit Gümüş arasındadır; Apple bu Koşulların tarafı değildir ve Uygulamalardan veya içeriklerinden sorumlu değildir.

02Kullanım lisansı

Bu Koşullara uymanız şartıyla, size Uygulamaları sahip olduğunuz veya kontrol ettiğiniz Apple cihazlarında kişisel ve ticari olmayan amaçlarla kullanmanız için sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz. Uygulamalar size satılmaz, lisanslanır.

03Kabul edilebilir kullanım

Uygulamaları kullanırken şunları yapmamayı kabul edersiniz:

Hile, bot, otomasyon aracı veya değiştirilmiş (modlu) sürümler kullanmak; hataları (bug) kendi lehinize istismar etmek.
Uygulamaları kopyalamak, değiştirmek, tersine mühendislik uygulamak, kaynak kodunu çıkarmaya çalışmak veya dağıtmak (yasanın açıkça izin verdiği durumlar hariç).
Satın alma sistemlerini atlatmaya çalışmak veya sanal öğeleri yetkisiz yollarla elde etmek.
Skor tabloları veya diğer oyuncuların görebileceği alanlarda saldırgan, yasa dışı veya başkalarının haklarını ihlal eden takma adlar ya da içerikler kullanmak.
Uygulamaların veya bağlı hizmetlerin işleyişini bozmaya çalışmak.

Bu kuralların ihlali halinde ilgili özelliklere erişimi kısıtlayabilir, skorları kaldırabilir veya hile ile elde edilen sanal öğeleri silebiliriz.

04Sanal para ve satın almalar

Bazı Uygulamalar coin, elmas veya benzeri sanal para birimleri ve sanal öğeler ("Sanal Öğeler") sunabilir. Bu öğeler oyun içinde kazanılabilir veya uygulama içi satın alma ile edinilebilir.

Sanal Öğeler size yalnızca Uygulama içinde kullanmanız için sınırlı bir lisans olarak verilir. Gerçek para değerleri yoktur; nakde, gerçek mallara veya başka bir değere çevrilemez.
Sanal Öğeler devredilemez, satılamaz ve başka bir hesaba veya cihaza aktarılamaz (Apple'ın satın alma geri yükleme özelliği hariç).
Tüketilebilir öğeler (ör. coin ve elmas paketleri) kullanıldığında tükenir. Uygulamayı silmek veya cihaz değiştirmek, bulut kayıt özelliği yoksa cihazda tutulan bakiyenin kaybolmasına neden olabilir.
Tüketilemeyen satın almalar (ör. reklam kaldırma) uygulamadaki "Satın Alımları Geri Yükle" seçeneğiyle aynı Apple kimliğiyle geri yüklenebilir.
Tüm ödemeler Apple tarafından işlenir ve Apple'ın koşullarına tabidir. İade talepleri Apple üzerinden yapılır (reportaproblem.apple.com). Apple tarafından iade edilen bir satın alma, Uygulamadaki karşılığıyla birlikte geri alınabilir.
Sanal Öğelerin fiyatlarını, içeriklerini ve kullanılabilirliğini değiştirme hakkımızı saklı tutarız. Yürürlükteki mevzuattan doğan tüketici haklarınız saklıdır.

05Abonelikler

Bir Uygulama abonelik sunarsa: abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmezse otomatik olarak yenilenir. Ücret, onay sırasında Apple hesabınızdan tahsil edilir. Aboneliklerinizi Apple kimliği ayarlarınızdan yönetebilir ve iptal edebilirsiniz. Uygulamayı silmek aboneliği iptal etmez.

06Reklamlar

Bazı Uygulamalar üçüncü taraf reklam ağlarından gelen reklamlar gösterebilir. Reklamlar kişiselleştirilmemiştir ve sizi takip etmez (ayrıntılar Gizlilik Politikası'nda). Reklamlarda yer alan üçüncü taraf ürün, hizmet veya web sitelerinden sorumlu değiliz.

07Fikri mülkiyet

Uygulamalar ve içerdikleri tüm yazılım, grafik, tasarım, karakter, ses, metin, logo ve diğer içerikler Halit Gümüş'e veya lisans verenlerine aittir ve fikri mülkiyet mevzuatıyla korunur. Bu Koşullarda açıkça verilen lisans dışında hiçbir hak size devredilmez.

08Üçüncü taraf hizmetler

Uygulamalar Apple Game Center, iCloud veya analitik ve reklam sağlayıcıları gibi üçüncü taraf hizmetleri kullanabilir. Bu hizmetlerin kullanımı ilgili sağlayıcının kendi koşullarına tabidir ve bu hizmetlerin kesintisiz çalışmasını garanti etmeyiz.

09Garanti reddi

Uygulamalar "olduğu gibi" ve "mevcut olduğu şekilde" sunulur. Yürürlükteki hukukun izin verdiği ölçüde, Uygulamaların kesintisiz, hatasız veya her cihazla uyumlu olacağına dair açık ya da örtülü hiçbir garanti vermeyiz. Uygulamaları güncelleyebilir, değiştirebilir veya yayından kaldırabiliriz.

10Sorumluluğun sınırlandırılması

Yürürlükteki hukukun izin verdiği azami ölçüde, Uygulamaların kullanımından veya kullanılamamasından doğan dolaylı, arızi veya sonuç niteliğindeki zararlardan (ör. veri veya oyun ilerlemesi kaybı) sorumlu değiliz. Her durumda toplam sorumluluğumuz, ilgili Uygulama için son 12 ayda ödediğiniz tutarla sınırlıdır.

Bu bölüm, kast veya ağır ihmalden doğan sorumluluğu ya da 6502 sayılı Tüketicinin Korunması Hakkında Kanun gibi emredici mevzuattan doğan haklarınızı sınırlamaz.

11Kullanımın sona ermesi

Uygulamayı cihazınızdan silerek istediğiniz zaman kullanmayı bırakabilirsiniz. Bu Koşulları ihlal etmeniz halinde lisansınız sona erebilir. Lisansın sona ermesiyle Uygulamayı kullanmayı bırakmanız gerekir. Doğası gereği devam etmesi gereken hükümler (ör. fikri mülkiyet, sorumluluk sınırlaması) yürürlükte kalır.

12Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Güncel sürüm her zaman bu sayfada yayınlanır ve "Son güncelleme" tarihi değiştirilir. Önemli değişikliklerde gerektiğinde Uygulama içinde bilgilendirme yaparız. Değişikliklerden sonra Uygulamaları kullanmaya devam etmeniz, güncel Koşulları kabul ettiğiniz anlamına gelir.

13Uygulanacak hukuk

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İstanbul (Merkez) Mahkemeleri ve İcra Daireleri yetkilidir. Tüketici sıfatıyla hareket ediyorsanız, ikametgâhınızdaki Tüketici Hakem Heyetlerine ve Tüketici Mahkemelerine başvurma hakkınız ile yaşadığınız ülkenin emredici tüketici koruma hükümleri saklıdır.

The rules that apply when you use Steed Studio apps and games.

These Terms of Use ("Terms") govern your use of all mobile apps, games and related services published by Halit Gümüş under the name "Steed Studio" (the "Apps"). By downloading or using an App, you agree to these Terms. If you do not agree, please do not use the Apps.

Play fair, have fun

You may use the Apps for your personal use. Don't cheat, copy or misuse them. Virtual items such as coins and gems have no real-money value. Payments and refunds are handled by Apple. Privacy topics are covered in the Privacy Policy.

01Apple license agreement

Apps downloaded from the App Store are licensed under Apple's Licensed Application End User License Agreement (the "Apple EULA"). These Terms supplement the Apple EULA. If there is a conflict, the Apple EULA prevails for Apps downloaded from the App Store.

These Terms are between you and Halit Gümüş; Apple is not a party to these Terms and is not responsible for the Apps or their content.

02License to use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes on Apple devices that you own or control. The Apps are licensed, not sold, to you.

03Acceptable use

When using the Apps, you agree not to:

Use cheats, bots, automation tools or modified ("modded") versions, or exploit bugs to your advantage.
Copy, modify, reverse engineer, attempt to extract the source code of, or distribute the Apps (except where the law expressly allows it).
Try to bypass purchase systems or obtain virtual items through unauthorized means.
Use offensive or illegal nicknames or content, or content that infringes others' rights, on leaderboards or other areas visible to other players.
Try to disrupt the operation of the Apps or connected services.

If these rules are broken, we may restrict access to related features, remove scores or delete virtual items obtained by cheating.

04Virtual currency and purchases

Some Apps may offer coins, gems or similar virtual currencies and virtual items ("Virtual Items"). These can be earned in the game or obtained through in-app purchases.

Virtual Items are granted to you only as a limited license to use within the App. They have no real-money value and cannot be exchanged for cash, real goods or anything else of value.
Virtual Items cannot be transferred, sold or moved to another account or device (except through Apple's restore purchases feature).
Consumable items (e.g. coin and gem packs) are used up when spent. If an App has no cloud save, deleting it or changing devices may cause an on-device balance to be lost.
Non-consumable purchases (e.g. remove ads) can be restored with the same Apple ID using the "Restore Purchases" option in the app.
All payments are processed by Apple and are subject to Apple's terms. Refund requests are made through Apple (reportaproblem.apple.com). If Apple refunds a purchase, its corresponding content in the App may be removed.
We may change the prices, contents and availability of Virtual Items. Your consumer rights under applicable law are not affected.

05Subscriptions

If an App offers a subscription: it renews automatically unless canceled at least 24 hours before the end of the current period. Payment is charged to your Apple account at confirmation. You can manage and cancel subscriptions in your Apple ID settings. Deleting the app does not cancel a subscription.

06Ads

Some Apps may show ads from third-party ad networks. Ads are non-personalized and do not track you (see the Privacy Policy). We are not responsible for third-party products, services or websites shown in ads.

07Intellectual property

The Apps and all software, graphics, designs, characters, sounds, text, logos and other content in them belong to Halit Gümüş or his licensors and are protected by intellectual property laws. No rights are transferred to you other than the license expressly granted in these Terms.

08Third-party services

The Apps may use third-party services such as Apple Game Center, iCloud, or analytics and ad providers. Your use of these services is subject to each provider's own terms, and we do not guarantee that they will operate without interruption.

09Disclaimer of warranties

The Apps are provided "as is" and "as available". To the extent permitted by applicable law, we make no express or implied warranty that the Apps will be uninterrupted, error-free or compatible with every device. We may update, change or withdraw the Apps.

10Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental or consequential damages (e.g. loss of data or game progress) arising from the use of, or inability to use, the Apps. In any case, our total liability is limited to the amount you paid for the relevant App in the last 12 months.

This section does not limit liability for intent or gross negligence, or your rights under mandatory law such as Turkey's Consumer Protection Law No. 6502.

11Termination

You may stop using an App at any time by deleting it from your device. Your license may end if you breach these Terms, in which case you must stop using the App. Provisions that by their nature should survive (e.g. intellectual property, limitation of liability) remain in effect.

12Changes

We may update these Terms from time to time. The current version is always published on this page with an updated "Last updated" date. For material changes, we will notify you in the App where appropriate. Continuing to use the Apps after changes means you accept the updated Terms.

13Governing law

These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul (Central) have jurisdiction over disputes. If you act as a consumer, your right to apply to the consumer arbitration committees and consumer courts where you live, and the mandatory consumer protection rules of your country of residence, are not affected.
